1. Introduction
These Terms of Service (“Terms”) govern the relationship between Offtrack Adventures (“Organizer”, “we”, “us”, or “our”) and individuals who book or participate in expeditions organized by Offtrack Adventures.
By booking a trip with Offtrack Adventures, you confirm that you have read, understood, and agreed to these Terms.
Offtrack Adventures specializes in travel to remote and adventurous destinations. Participants must understand that infrastructure, medical facilities, transportation systems, and logistical conditions may differ significantly from those found in more developed regions.
2. Booking Process
All bookings are subject to availability and confirmation by Offtrack Adventures.
A reservation is considered confirmed only once:
- the required deposit or payment has been received, and
- a confirmation email has been issued by Offtrack Adventures.
We reserve the right to decline or cancel a booking where necessary.
3. Payments and Deposits
Payment schedules vary depending on the expedition and will be clearly communicated during the booking process.
Typically, bookings require:
- an initial deposit to secure a place on the expedition
- additional payments according to the payment schedule provided in the expedition details
Failure to complete payments by the stated deadlines may result in cancellation of the reservation without refund.
4. Travel Documentation and Visas
Participants are responsible for ensuring that all travel documentation is valid and up to date, including:
- passports
- visas
- required entry permits
While Offtrack Adventures may provide general guidance regarding visa requirements, participants remain fully responsible for obtaining the appropriate visas and complying with entry regulations.
Offtrack Adventures cannot be held responsible for denied entry or visa refusals.
5. Travel Insurance
Comprehensive travel insurance is mandatory for all participants.
Insurance must include coverage for:
- emergency medical treatment
- emergency evacuation
- trip cancellation or delay
- baggage loss or damage
- personal liability
Participants may be required to provide proof of valid travel insurance before the expedition begins.
6. Customer Responsibilities
Participants are responsible for:
- arriving at the expedition starting point on time
- arranging their own international travel unless otherwise specified
- complying with local laws and customs
- following instructions from guides, hosts, and expedition leaders
Participants must ensure they are physically and medically fit to participate in the expedition and must disclose any relevant medical conditions prior to departure.
Failure to comply with safety instructions or unacceptable behavior may result in removal from the expedition without refund.
7. Cancellations and Refunds
Due to the logistical complexity of organizing remote expeditions and the advance commitments required with local partners, deposits and payments are generally non-refundable once received.
Cancellations must be submitted in writing via email.
If a participant cannot attend, Offtrack Adventures may, at its discretion, assist in identifying a replacement participant or offer the possibility of applying payments toward a future expedition.
Cancellations made close to the expedition start date may not be eligible for refunds or credits due to confirmed operational costs.
Participants are strongly encouraged to rely on their travel insurance in the event of personal circumstances preventing participation.
8. Expedition Changes and Force Majeure
Offtrack Adventures reserves the right to modify, postpone, or cancel an expedition if circumstances beyond our control make it unsafe or impractical to proceed.
Such circumstances may include, but are not limited to:
- natural disasters
- political instability
- government restrictions
- safety concerns
- transportation disruptions
If an expedition must be rescheduled, participants may be offered the option to transfer their booking to a new departure or another expedition.
9. Itinerary Changes and Delays
Expedition travel requires flexibility.
Offtrack Adventures reserves the right to modify itineraries, accommodations, or planned activities when necessary due to:
- safety considerations
- logistical challenges
- weather conditions
- local operational factors
While we aim to maintain the planned experience, itinerary changes may occasionally occur and do not automatically entitle participants to refunds.
Participants are encouraged to allow sufficient buffer time when booking onward travel after the expedition.
10. Liability and Risk Disclaimer
Expedition travel involves inherent risks, particularly in remote and challenging environments.
While Offtrack Adventures takes reasonable measures to plan and conduct expeditions safely, certain risks cannot be eliminated.
By participating in an expedition, participants acknowledge and accept these risks.
Except where liability cannot legally be excluded, Offtrack Adventures shall not be liable for injury, illness, loss, delay, or damage that may occur during the expedition.
11. Data Protection
Offtrack Adventures respects the privacy of its participants.
Personal information collected during the booking process will only be used for purposes related to:
- organizing travel arrangements
- expedition logistics
- communication regarding the trip
We do not share personal information with unauthorized third parties.
12. Trip Participation Agreement
All participants are required to review and sign a Trip Participation Agreement before joining an expedition.
This agreement contains additional expedition-specific details including:
- payment schedules
- risk acknowledgments
- operational policies
- participant responsibilities
In the event of any discrepancy, the signed Trip Participation Agreement shall take precedence.
13. General Provisions
13.1 Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the United Arab Emirates. Any disputes arising in connection with these Terms shall be subject to the jurisdiction of the courts of the United Arab Emirates.
13.2 Amendments
Offtrack Adventures reserves the right to modify or update these Terms at any time. Any significant changes will be communicated through our official communication channels or published on our website.
13.3 Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions shall continue to remain valid and enforceable.
